1. Introduction

Welcome to Decal Empire. These terms and conditions outline the rules and regulations for the use of our website and services.

By accessing this website and placing an order, we assume you accept these terms and conditions. Do not continue to use Decal Empire if you do not agree to all of the terms and conditions stated on this page.

Nothing in these Terms affects your statutory rights as a consumer.

2. Definitions

  • "Company", "We", "Us", "Our" refers to Decal Empire LTD.
  • "Customer", "You", "Your" refers to the person placing an order.
  • "Consumer" refers to a Customer acting for purposes wholly or mainly outside their trade, business, craft, or profession.
  • "Products" refers to all stickers, decals, and related items available for purchase.
  • "Website" refers to decalempire.co.uk and all associated pages.
  • "Service" refers to the products, website, and any related services provided by Decal Empire.

3. Orders and Payment

3.1 Order Acceptance and Contract Formation

All orders are subject to acceptance and availability. Your order constitutes an offer to purchase. A binding contract is formed only when we accept your order, which occurs when we confirm your artwork proof approval and begin production, or when we dispatch your Products, whichever is earlier. Our order acknowledgement email is confirmation that we have received your order, not acceptance of it.

We reserve the right to refuse any order prior to acceptance, in which case any payment taken will be refunded in full.

3.2 Pricing

All prices are displayed in GBP and include UK VAT where applicable. Prices may change at any time, but changes will not affect orders we have already accepted.

For orders delivered to European Union countries, taxes and customs charges are applied as set out in clause 7.

3.3 Payment

Payment must be made in full at the time of ordering. We accept major credit and debit cards through our secure payment processor (Stripe).

4. Artwork and Design

4.1 Artwork Submission

Customers are responsible for providing high-quality artwork files. We accept PNG, PDF, AI, PSD, and other common formats.

4.2 Proofing

We provide digital proofs for approval before printing. You are responsible for checking all details including spelling, sizing, and positioning.

4.3 Copyright and Intellectual Property

By submitting artwork, you confirm that:

  • You own all rights, including copyright, in the artwork or material you submit, OR
  • You have obtained all necessary permissions and licences to use the artwork
  • The artwork does not infringe any third-party rights, including copyright, trademark, and privacy rights

You agree to indemnify and hold harmless Decal Empire LTD from any claims, damages, losses, or expenses arising from any breach of these terms, including any infringement of third-party intellectual property rights.

We are not responsible for any claims or damages arising from the use of artwork you provide, including claims for copyright infringement.

5. Production and Delivery

5.1 Production Time

Standard production time is 5-7 working days after proof approval. Rush orders may be available at additional cost.

5.2 Delivery

We use tracked delivery services. Standard delivery is included with all orders. Delivery times are estimates and not guaranteed. We are not responsible for delays caused by postal services, couriers, or customs processing in the destination country.

For deliveries outside the United Kingdom, quoted delivery times exclude any time taken for customs clearance.

5.3 Delivery Address

You are responsible for providing accurate delivery information. We are not liable for orders delivered to incorrect addresses provided by the customer.

5.4 Risk and Ownership

Products are at your risk from the time of delivery to the address you provided. Ownership of the Products passes to you once we have received payment in full.

6. Cancellation, Returns and Refunds

6.1 Faulty or Incorrectly Produced Products

If you receive Products that are faulty, damaged, or not as specified in your approved proof, please contact us as soon as possible so we can put things right. We will arrange a replacement or refund.

If you are a Consumer, nothing in these Terms limits your statutory rights, including your rights under the Consumer Rights Act 2015 where Products are faulty, not as described, or unfit for purpose. This includes, where applicable, a short-term right to reject faulty goods within 30 days of delivery, and rights to repair, replacement, or refund thereafter. If you are a Consumer in the European Union, you also benefit from the legal guarantee of conformity under the laws of your country of residence, which lasts a minimum of two years from delivery.

6.2 Customer Error

We cannot offer refunds for Products printed correctly but based on customer-approved proofs containing errors. This does not affect your rights in respect of faults for which we are responsible.

6.3 Custom-Made Products and Cancellation

All of our Products are made to your specification, produced from artwork you supply. Because of this, the statutory right to cancel a distance contract within 14 days does not apply, in accordance with the exemption for goods made to the consumer's specifications or clearly personalised under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and, for EU Consumers, Article 16(c) of Directive 2011/83/EU.

This means we cannot accept returns or cancellations for change of mind once production has begun. If you need to cancel before you have approved your proof, contact us and we will refund you in full.

This clause does not affect your rights under clause 6.1 in respect of faulty or incorrectly produced Products.

7. International Orders, Taxes and Customs

7.1 European Union Orders up to €150

For orders delivered to an EU country where the value of the goods does not exceed €150, we collect at checkout: (a) VAT at the rate applicable in your country of delivery, declared under the EU Import One-Stop-Shop (IOSS) scheme, and (b) the EU customs charge of €3 per product type applicable to consignments not exceeding €150. These amounts are shown as separate line items before you pay. No further tax, duty, or customs charge is payable on delivery for these orders.

7.2 European Union Orders over €150

For orders delivered to an EU country where the value of the goods exceeds €150, prices at checkout do not include import VAT, customs duties, or carrier handling fees. You are the importer of record and are responsible for any import charges collected by the carrier or customs authority in your country before delivery. We will declare the contents and value of your order accurately on the customs documentation.

7.3 Business Customers in the EU

Orders placed by VAT-registered businesses in the EU that provide a valid VAT number are treated as zero-rated exports from the UK. The business customer is the importer of record and is responsible for import VAT and any duties in the destination country.

7.4 Other International Orders

For deliveries outside the UK and EU, you are responsible for any import taxes, duties, or fees imposed by the destination country.

8. Website Use and Analytics

8.1 Acceptable Use

You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the Website.

8.2 Analytics and Cookies

We use cookies and analytics tools (including Google Analytics and Microsoft Clarity) to improve our website and services. By using our Website, you acknowledge our use of these technologies as described in our Privacy Policy.

You can manage your cookie preferences through the cookie consent banner presented when you first visit our site, or through your browser settings.

8.3 Third-Party Tools

We may provide access to third-party tools and services. We do not monitor or control these tools and provide access to them "as is" without any warranties. Your use of third-party tools is at your own risk.

9. Limitation of Liability

9.1 Service Provision

We will use reasonable care and skill in providing our services. However, we do not guarantee that your use of our Service will be uninterrupted, timely, secure, or error-free.

9.2 Liability Limits

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded under applicable law

To the extent permitted by law, we shall not be liable for any indirect or consequential losses, including loss of profit, revenue, or data arising out of or in connection with these Terms or your use of the Service.

Our total liability to you for all other losses shall not exceed the total amount paid by you for the products and services in question.

10. Indemnification

You agree to indemnify and hold harmless Decal Empire LTD and our affiliates, officers, directors, agents, and employees from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms or your violation of any law or the rights of a third party.

11. Personal Information

Your submission of personal information through the website is governed by our Privacy Policy. Please take the time to read our Privacy Policy, as it includes important terms which apply to you.

12. Errors and Inaccuracies

Occasionally, there may be information on our website that contains typographical errors, inaccuracies, or omissions related to product descriptions, pricing, or availability. We reserve the right to correct any errors and to change or update information without prior notice. Where a pricing error is obvious and could reasonably have been recognised as an error, we are not obliged to fulfil the order at the incorrect price and will offer you the choice of paying the correct price or cancelling with a full refund.

13. Events Outside Our Control

We are not liable for any failure or delay in performing our obligations where that failure or delay results from events beyond our reasonable control, including but not limited to industrial action, supplier or carrier failure, fire, flood, epidemic, power failure, or the act of any government or authority. If such an event substantially delays your order, you may cancel it and receive a full refund for undelivered Products.

14. Termination

These Terms are effective unless and until terminated by either you or us.

You may terminate these Terms at any time by ceasing to use our website and services.

If you materially breach any of these Terms, we may suspend or terminate this agreement, and you will remain liable for all amounts due up to the date of termination. This does not affect any accepted orders already paid for, which we will fulfil or refund.

15. Severability

If any provision of these Terms is determined to be unlawful or unenforceable, such provision shall be enforceable to the fullest extent permitted by applicable law. The unenforceable portion shall be deemed severed from these Terms, and this determination shall not affect the validity of any other remaining provisions.

16. Entire Agreement

These Terms and any policies referenced herein (including our Privacy Policy) constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements.

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

17. Governing Law and Jurisdiction

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of England and Wales.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of England and Wales.

If you are a Consumer resident in the European Union, you benefit from any mandatory provisions of the consumer protection law of your country of residence, and nothing in these Terms deprives you of that protection. You may also bring proceedings in the courts of your country of residence, and if you are resident in Scotland or Northern Ireland, in the courts of Scotland or Northern Ireland respectively.

18. Changes to Terms

We reserve the right to update, change, or replace any part of these Terms by posting updates to our website.

Changes apply to orders placed after the updated Terms are posted. The version of these Terms in force when we accept your order is the version that applies to that order.
